Terms and Conditions for Frankston Electrical Air Conditioning Group Services

1. General1.1 These terms and conditions ("Terms") govern all services provided by Frankston Electrical Air Group ("we", "us", "our"), owned by Ben Settree, ABN 82 622 381 006, to our clients ("you", "your").  1.2 By engaging our services, you agree to these Terms in full.  1.3 These Terms comply with the relevant laws and regulations of Victoria, Australia, including the Australian Consumer Law (ACL).  

2. Scope of Services2.1 We provide electrical and air conditioning services, including but not limited to installation, repair, maintenance, and inspection of electrical and air conditioning systems and components.  2.2 The specific scope of work will be outlined in a written quote or service agreement provided before commencing any work.  

3. Quotations and Pricing3.1 All quotations are valid for 30 days unless otherwise stated.  3.2 Prices include GST unless specified otherwise.  3.3 Any additional work outside the scope of the quotation will be subject to additional charges, which will be communicated and agreed upon before proceeding.  

4. Payment Terms4.1 Payment is required within 7 days of the invoice date unless otherwise agreed in writing.  4.2 We accept payment via bank transfer, credit card, and other agreed methods.  4.3 Late payments may incur a late fee of 5% per month on any outstanding balance.  

5. Cancellation and Rescheduling5.1 If you need to cancel or reschedule an appointment, please provide at least 24 hours' notice.  5.2 Cancellations made with less than 24 hours' notice may incur a cancellation fee of $50.  

6. Client Responsibilities6.1 You must provide safe and clear access to the worksite and ensure that all necessary consents or approvals are obtained prior to our arrival.  6.2 Any hazards or risks on-site must be disclosed to us before work commences.  

7. Warranties and Liability

7.1 We warrant that our services will be performed with due care, skill, and diligence. 

 7.2 Materials and parts supplied by us are covered by the manufacturer's warranty.  

7.3 We are not liable for:   - Damage caused by misuse, negligence, or unauthorized modifications by you or third parties.    - Delays or failures caused by circumstances beyond our reasonable control, including weather events, supply chain delays, and other unforeseen conditions.  

7.4 Nothing in these Terms excludes, restricts, or modifies any rights you have under the Australian Consumer Law.  

8. Health and Safety8.1 We adhere to all relevant health and safety regulations in Victoria.  8.2 We reserve the right to cease work immediately if we identify a significant health or safety risk on-site.  

9. Termination9.1 We may terminate the service agreement if you breach these Terms or fail to pay for services rendered.  9.2 Termination does not affect any accrued rights or obligations of either party.  

10. Privacy10.1 We collect and use your personal information in accordance with our Privacy Policy, which is available upon request.  

11. Dispute Resolution11.1 If a dispute arises, both parties agree to attempt to resolve it through negotiation in good faith before pursuing further legal action.  

12. Governing Law12.1 These Terms are governed by the laws of Victoria, Australia.  12.2 Any disputes will be subject to the jurisdiction of the courts in Victoria.
